These Terms of Service (“Terms”) govern your access to and use of hollietrading.com and your purchase of products from our online store.

The Website and store are operated by Hollietrading LLC under the store name HOLLIETRADING (“we,” “us,” or “our”).

By accessing the Website or submitting an order, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. Eligibility and Customer Information

You must be at least the age of majority in your state of residence to place an order.

You agree to provide accurate, current, and complete information during checkout, including your name, email address, telephone number, billing information, and shipping address.

You are responsible for reviewing your information before submitting an order and for keeping any customer-account credentials confidential.

2. Products and Product Information

We sell decorative flower baskets, hanging and wall-mounted flower baskets, woven baskets, decorative wall planters, floral holders, and related home décor products.

We make reasonable efforts to display product descriptions, dimensions, materials, colors, designs, package contents, photographs, and prices accurately.

However:

  • Colors may appear slightly different depending on lighting, photography, and screen settings;
  • Dimensions may vary slightly depending on the product material, construction, shaping, and measuring method;
  • Woven textures, wood-tone finishes, floral arrangements, and other decorative details may have minor variations;
  • Some woven, floral, or flexible decorative products may be folded or compressed for packaging and may require minor reshaping after unpacking; and
  • Flowers, greenery, mounting accessories, or other decorative items shown in product photographs are included only when specifically stated in the product description.

Customers should review the complete product description, dimensions, materials, package contents, and intended use before ordering.

3. Product Use and Care

Our products are intended primarily for decorative household use according to the descriptions provided on their individual product pages.

Customers must use and install products according to their descriptions and any provided instructions.

Unless expressly stated otherwise, our flower baskets, wall planters, hanging baskets, and decorative holders:

  • Are not designed to support a person’s body weight;
  • Must not be used as seating, climbing equipment, structural supports, or load-bearing fixtures;
  • Should be installed using mounting methods appropriate for the product and wall surface;
  • Should be kept away from open flames, excessive heat, and prolonged moisture;
  • Should not be treated as waterproof or suitable for outdoor use unless specifically stated on the product page; and
  • Should be cleaned and maintained only using methods appropriate for the stated material.

Damage caused by misuse, improper installation, modification, improper cleaning, improper storage, exposure to unsuitable conditions, or use for a purpose not described on the product page is not considered a product defect.

4. Product Availability

Products are offered subject to availability.

Placing a product in the shopping cart does not reserve it. We may limit quantities, discontinue products, or correct availability information when reasonably necessary.

If a product becomes unavailable after an order is submitted, we may cancel the affected item and issue a refund to the original payment method.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order-receipt email confirms that we received the order but does not necessarily mean that the order has been accepted.

An order is accepted after payment has been successfully authorized and we confirm that the order can be fulfilled.

We may decline, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability;
  • Incorrect pricing or product information;
  • Payment-authorization problems;
  • Suspected fraud or unauthorized activity;
  • An incomplete or invalid delivery address;
  • Orders outside our supported shipping area;
  • Unusually large quantities or suspected unauthorized resale; or
  • Legal or regulatory requirements.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment transaction.

6. Prices and Payment

All prices are displayed in United States dollars (USD) unless otherwise stated.

Applicable shipping charges and taxes will be displayed during checkout before the order is submitted.

We currently accept payments through PayPal. PayPal processes payment information according to its own terms and privacy practices.

We do not directly store complete PayPal login credentials or complete payment-card information.

7. Pricing and Website Errors

We may correct typographical errors, inaccurate product information, pricing errors, availability errors, or other Website mistakes.

If an error materially affects an order, we may contact the customer to request confirmation or cancel the affected item and issue a refund.

We will not substitute a materially different product without the customer’s agreement.

8. Shipping and Delivery

We currently accept orders for delivery to eligible addresses within the 48 contiguous United States.

We do not currently ship to Alaska, Hawaii, Puerto Rico, other U.S. territories, APO/FPO/DPO addresses, or international destinations.

Processing time, shipping charges, estimated delivery periods, tracking, address problems, carrier delays, and shipping claims are governed by our Shipping Policy.

Delivery estimates are not guaranteed delivery dates.

9. Returns and Refunds

Eligible products may be returned according to our Return and Refund Policy.

Return eligibility depends on factors including the return-request date, product condition, signs of use or installation, cleanliness, original components, and return authorization.

The Return and Refund Policy controls return shipping, inspection, damaged-product, exchange, and refund procedures.

Nothing in these Terms limits consumer rights that cannot legally be excluded.

10. Personal and Household Use

Products purchased from the Website are intended primarily for personal or household use.

You may not use the Website or purchase products for fraud, unlawful export, unauthorized commercial resale, or other unlawful activity.

Wholesale or resale activity requires our prior written approval.

11. Intellectual Property

The Website and its content—including the store name, logo, product descriptions, photographs, graphics, text, layout, and other materials—are owned by or licensed to Hollietrading LLC and may be protected by intellectual-property laws.

You may use the Website for personal shopping purposes.

You may not copy, reproduce, republish, distribute, modify, scrape, sell, or commercially exploit Website content without prior written permission, except where permitted by law.

Third-party names, logos, and materials remain the property of their respective owners.

12. Reviews and Submitted Content

If you submit a product review, photograph, suggestion, comment, or other content, you confirm that:

  • You own the content or have permission to submit it;
  • It reflects your genuine experience;
  • It is not false or misleading;
  • It does not violate another person’s rights;
  • It is not unlawful, abusive, defamatory, or obscene; and
  • It does not contain spam, malware, or unauthorized advertising.

You grant us a non-exclusive, worldwide, royalty-free license to use and display submitted content for operating and promoting the Website and our products.

We may remove content that violates these Terms or applicable law.

13. Prohibited Uses

You may not:

  • Use the Website for unlawful, fraudulent, or deceptive activity;
  • Provide false customer, billing, payment, or delivery information;
  • Attempt unauthorized access to the Website or related systems;
  • Introduce viruses, malware, or harmful code;
  • Interfere with Website security or operation;
  • Collect personal information about others without authorization;
  • Impersonate another person;
  • Infringe intellectual-property or privacy rights; or
  • Use automated systems in a manner that disrupts or places an unreasonable burden on the Website.

We may restrict access when we reasonably believe these Terms have been violated.

14. Shopify, PayPal, and Third-Party Services

Our online store is hosted using Shopify’s ecommerce platform.

Shopify provides Website and checkout infrastructure but is not the seller of the products offered through HOLLIETRADING. Purchases are transactions between the customer and Hollietrading LLC.

PayPal provides payment-processing services and is not responsible for product fulfillment, shipping, or returns.

Third-party services are governed by their own terms and privacy policies. We are not responsible for services or websites that we do not control.

15. Privacy

Our handling of personal information is described in our Privacy Policy.

Information may be processed by Shopify, PayPal, shipping providers, and other service providers where necessary to operate the Website, process orders, provide customer support, prevent fraud, and comply with law.

16. Website Availability and Disclaimer

We make reasonable efforts to maintain accurate Website information and reliable operation. However, the Website may occasionally be interrupted because of maintenance, updates, technical problems, or circumstances outside our control.

To the fullest extent permitted by law, the Website is provided on an “as available” basis.

We do not guarantee that the Website will always be uninterrupted or error-free.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Hollietrading LLC will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Website.

We are not responsible for damage caused by using, mounting, installing, cleaning, storing, or displaying a product contrary to its description, intended purpose, care instructions, or provided installation information.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by negligence, or another liability that cannot legally be excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold Hollietrading LLC harmless from third-party claims or reasonable expenses resulting from:

  • Your unlawful use of the Website;
  • Your material violation of these Terms;
  • Fraudulent or intentionally harmful conduct; or
  • Your infringement of another person’s rights.

This provision does not apply to claims caused by our own violation of law or these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal laws of the United States, without regard to conflict-of-law principles.

Disputes will be handled by a court with lawful jurisdiction, subject to any mandatory consumer right allowing a claim to be brought elsewhere.

20. Changes to These Terms

We may update these Terms when our Website, products, business practices, or legal obligations change.

The updated version will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively and do not retroactively change the material terms of an order already accepted unless required by law.

21. Severability and No Waiver

If part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

22. Entire Agreement

These Terms and the policies provided on the Website constitute the agreement concerning use of the Website and purchases from Hollietrading LLC.

If a specific policy conflicts with these Terms regarding its particular subject, the more specific policy applies to that subject.
